Harris County DA's Office 'Fesses Up to Error

There's an interesting twist to the story of the indictment of Texas Supreme Court Justice David Medina and his wife for arson, and its subsequent dismissal due to a technicality. Harris County Assistant District Attorney Kate Dolan has taken responsibility for the error that invalidated over thirty grand jury indictments due to the jurors' term being improperly extended.

It's tempting to think that she's simply taking the fall for someone else who was looking to leverage a "mistake" to help out a political ally on the Supreme Court, particularly when the someone else would be embattled District Attorney Chuck Rosenthal, who is already facing a lawsuit for contempt.

But Dolan is insistent that it was simply a mistake, and one that would be remedied as defendants are re-indicted over time. The Chron article mentions that the defendants for a large mortgage fraud case are scheduled to go before a grand jury on Friday. No word yet as to whether or when Justice Medina's case would be reheard.
